The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations and this data protection declaration.

2 Which personal data do we collect and store? 

We process data which we receive from you directly in connection with our business relationship, for example in the context of an offer inquiry and the concrete placing of an order as well as the provision of our services.

Specifically, we process the following data:

- Name, address, e-mail address (other customer master data if applicable) - Correspondence (correspondence with you)

In connection with customer contracts / in the activation of customer accounts additionally:

Account details, complete application documents (if applicable with bank confirmation, data protection confirmation), if applicable data concerning creditworthiness and EU sanctions list for the prevention of money laundering and terrorism, if applicable data concerning the beneficial owner ("WB Check")

3. for what purpose and on what legal basis are these data used?  

The collection of your data is first of all for the fulfilment of contractual obligations, in particular 

to identify you as a customer; to process and answer customer enquiries appropriately; to fulfil contracts with you as agreed; to process customer change requests (concerning the data of the respective customer); to record sales conversations if necessary; to activate customer accounts (the activation of a customer with regard to the services of Heinrich Eggersmann Futtermittelwerke GmbH is regularly only carried out when certain documents [see below under point 5.] are available. By processing the corresponding data, Eggersmann complies with its legal obligations to identify business partners. In addition, the data are required for creditworthiness checks); for invoicing; for the settlement of any claims against you that may exist.

The data processing is carried out on the basis of your order, in order to carry out services for you as a commissioned processor and is thus required in accordance with Art. 6 Paragraph 1 letter b EU-DSGVO for the purposes mentioned in the context of the execution of our contracts and the appropriate fulfilment of the business relationship.

The data processing is also based on the service actually provided. Further details can be found in the respective contract documents and terms of business.

Insofar as you have given us your consent to process personal data for specific purposes (e.g. receipt of the newsletter), data processing is lawful in accordance with Art. 6 para. 1 lit. a EU-DSGVO. Any consent you have given can be revoked at any time.

4 Who will my data be passed on to?

Your customer data will not be passed on to third parties or transferred in any other way without your consent. Exceptions to this are transmissions of personal data to state institutions and authorities as well as private holders of rights on the basis of legal regulations or judicial or official decisions as well as the transmission to state institutions and authorities in the case of attacks on our legal assets for the purpose of legal or criminal prosecution. The legal basis for this processing of your personal data is Art. 6 para. 1 sentence 1 lit. c EU-DSGVO (fulfilment of a legal obligation).

In addition, we will also act on your behalf - depending on the specific assignment - in the context of credit assessment, SEPA payment processing, in accordance with Art. 28 EU-DSGVO and conclude agreements on order processing with you as our customer. In order to fulfil the obligations arising from the order processing agreements with you, we make use of the services of external service providers to whom personal data is passed on on the basis of corresponding order processing agreements. We would like to point out that you, as our client, remain the responsible party with regard to your personal data and the personal data of your end customers in accordance with the EU-DSGVO.

5 How long will my data be stored?

Unless otherwise stated in the other provisions of this notice, we will store the personal data obtained from you in connection with our business relationship only as long as this is necessary for the fulfilment of our contractual (e.g. competitions) and legal obligations. Afterwards, we will delete these data.

In addition, we store your customer data only to the extent and to the extent that we are obliged to do so due to mandatory legal, e.g. commercial or tax retention obligations. If we no longer need your data for the purposes described above, it will be stored only temporarily during the respective legal retention period and will not be processed for other purposes.

6. what are my rights as a data subject?

You have the right:

- to revoke any consent you may have given us at any time in accordance with Art. 7 Par. 3 EU-DSGVO. As a result, we may no longer continue to process the data which was based on this consent in the future;

- in accordance with Art. 15 EU-DSGVO, to request information about your personal data processed by us. In particular, you may request information on the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, erasure, restriction of processing or opposition, the existence of a right of appeal, the origin of your data if not collected by us, and the existence of automated decision making including profiling and, where applicable, meaningful information on the details of such data;

- in accordance with Art. 16 EU-DSGVO, immediately demand the correction of incorrect or incomplete personal data stored by us;

- in accordance with Art. 17 EU-DSGVO, to demand the deletion of your personal data stored with us, unless processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;

- pursuant to Art. 18 EU-DSGVO, to demand the restriction of the processing of your personal data insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer require the data, but you require it for the assertion, exercise or defence of legal claims or you have lodged an objection to the processing pursuant to Art. 21 EU-DSGVO;

- in accordance with Art. 20 EU-DSGVO, to receive your personal data that you have provided us with in a structured, common and machine-readable format or to request that it be transferred to another responsible party and

- complain to a supervisory authority in accordance with Art. 77 EU-DSGVO. As a rule, you can turn to the supervisory authority at your place of business.

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 letter f EU-DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 EU-DSGVO, provided that there are reasons for doing so arising from your particular situation.
